 Services offered by the Unit of Trade Marks and Patents   

The Office of Trade Marks and Patents at the Union of Chambers of Commerce & Industry of Albania is the authorized representative by the General Department of Trade Marks and Patents for the registration of the industrial property in Albania.  

We advise and assist companies to convert their ideas into capitals and also to use and protect their rights in the industrial property sector.

The Union performs applications for registration of trade marks and patents, performs applications for changes in previous registrations, renewal of trade marks and upholding patents’ validation, registration of licensed contracts and change of ownership, launching an application for international trade mark registration etc.

At present, the Office of Trade Marks and Patents at the Union of Chambers of Commerce & Industry of Albania carries out various number of services to Albanian and foreign clients and has in its archives well known Trade Marks from all around the world.

What is a trade mark or its services

  • Industrial property includes: inventions (patents), methods of use, industrial designs trade marks and geographic indicators of source.
  • Industrial Property can be protected only by registering the Trade Marks or other means.

If one business does not register its product or service, then he does not have any legal     means to get protection against falsification and unfair competition in the market.

The Trade Mark is a word, symbol, phrase, drawing or combination of words, phrases or drawings that identify and distinguish the source of the goods of one party from another one.   

The definition of the service Trade Mark is the same with that of the Trade Mark, with the exception that they identify and differentiate the source of the services and not of the products.

The trade mark qualities are:

  • Words, combination of words including also personal names. 
  • Letters, numbers.
  • Figurative signs, drawings included. 
  • Three dimensional shapes including goods shape and their packages.
  • Colors, their combinations, light’s shape if they are shown graphically 
  • The combination of the above mention components.

Qualities not pertaining to the Trade Mark

  • Not every symbol can be protected as a trade mark, thus the law can refuse the registration of the trade mark if:
  • The deposit trade mark can run against the public moral rules.
  • The deposit Trade Mark is part of the state emblems or international organizations, flags or religious    symbols. 
  • Trade Marks similar to the well know persons or their nicknames taken without their consent.
  • On the other hand the fact the Trade Mark is registered in the Register of Trade Marks is not part of the requirements to refuse its registration. This is the right of the former owner of the Trade mark, who will decide to allow or object its registration.
